Terms of Service
Last updated October 6, 2026
These terms are an agreement between you and Return On Influence, Inc. ("ROI", "we" or "us"). They cover your use of the ROI website at itsroi.com and the ROI app (together, "ROI"). By using ROI, you agree to them. If you use ROI on behalf of a company or another person, you're agreeing on their behalf, and you confirm you're allowed to.
Our Privacy Policy explains how we handle your information.
What ROI does
ROI reads the accounts you connect, works out what your audience is likely to buy, and recommends products and plans for launching them. If you decide to go ahead, we can make the products for you with manufacturing partners we've vetted.
ROI is new and invite-only. We add and change features often, and some may not always work as expected.
Your account
- You must be at least 18 and able to enter into a contract.
- Our team sets up your account. Keep your login to yourself. You're responsible for what happens in your account.
- Give us accurate information and keep it up to date.
- Tell us at [email protected] straight away if you think someone else has used your account.
Connecting your accounts
- Only connect accounts you own or are authorized to manage.
- When you connect an account, you allow ROI to read the information described in our Privacy Policy until you disconnect it.
- Each platform's own terms still apply to how you use it. By connecting your YouTube account, you agree to be bound by the YouTube Terms of Service.
- Platforms can change or stop what they let us read. If that happens, parts of ROI may stop working, and we aren't responsible for it.
Predictions and plans
Everything ROI recommends is a prediction based on the information available to us. That includes which products to make, how many, prices, launch dates, sales estimates and campaign ideas. Predictions can be wrong. You decide what to make and sell, and that decision is yours. We don't promise any level of sales or results.
Plans are written with the help of AI. Check them before you act on them, including names, dates and anything a plan says about a product.
Orders and production
- Placing an order in ROI asks us to make something. It isn't binding on either of us until we confirm it in writing, with the price, quantities, timeline and any other terms (an "Order Confirmation").
- Each Order Confirmation, together with any production agreement we sign with you, sets out the commercial terms: what you pay or how we share revenue, any minimums, payment, delivery, and what happens if something goes wrong. Where those terms conflict with these, those terms apply to that order.
- Production timelines are estimates. Factories, materials and shipping can cause delays.
- We can decline to make any product, for example if it might infringe someone's rights, break the law, or not be something our partners can make safely.
- Once production has started, you may not be able to cancel, and you may have to pay for work already done, as the Order Confirmation sets out.
Your content and brand
- You own what you bring to ROI: your content, name, likeness, logos, designs and other materials ("Your Materials").
- You give ROI a non-exclusive, worldwide license to use Your Materials to provide ROI to you, and to design, produce, promote and sell the products you order, for as long as we need to do those things.
- You confirm that you have the rights to Your Materials, and that our using them as these terms allow won't infringe anyone's rights.
- Between you and us, you may use the plans, product ideas and designs ROI produces for you. ROI may suggest similar ideas to others, and we can't promise that what ROI suggests is free of other people's rights. Check names, phrases and designs, including for trademarks, before you sell them.
ROI's property
ROI's software, design, models and content belong to ROI or our licensors. You may use them only to use ROI as these terms allow. If you send us feedback or ideas, we may use them without owing you anything.
What you can't do
- Use ROI to break the law or infringe anyone's rights.
- Connect accounts you don't control, or misrepresent your audience or sales.
- Copy, scrape, reverse engineer or resell ROI, or try to get around its limits or security.
- Interfere with ROI or with anyone else's use of it.
- Use ROI to make products that are illegal, unsafe, or infringe someone's intellectual property.
Fees
Using ROI during early access is free unless we agree otherwise in writing. Fees for products and production are set in each Order Confirmation or production agreement. We'll tell you before any other fee applies.
Suspending or closing your account
- You can stop using ROI at any time and ask us to close your account.
- We can suspend or close your account if you break these terms, if the law requires it, or if we stop offering ROI. Where we reasonably can, we'll tell you first.
- Orders we've already confirmed are handled under their Order Confirmation.
- The sections of these terms that by their nature should continue after your account is closed, such as ownership, disclaimers, limits on liability and disputes, continue.
Disclaimers
ROI is provided "as is" and "as available". As far as the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or the accuracy of any prediction. Nothing in these terms limits rights you have under consumer protection laws that can't be excluded.
Limits on our liability
As far as the law allows:
- We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
- Our total liability for all claims relating to ROI is limited to the greater of the amounts you paid ROI in the 12 months before the claim and US$100.
These limits don't apply where the law doesn't allow them.
Indemnity
You'll defend ROI against, and pay for, any claims, losses and costs (including reasonable legal fees) arising from Your Materials, your breach of these terms, or your misuse of ROI.
Disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute will be decided by the state and federal courts located in Delaware, and you and we agree to their jurisdiction.
Changes to these terms
We may update these terms. We'll post the new version here and update the date at the top. If a change affects you significantly, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using ROI after that, you accept the new terms.
General
- These terms, together with any Order Confirmations and production agreements, are the whole agreement between you and us about ROI.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term, we haven't given up the right to.
- You can't transfer these terms without our consent. We may transfer them as part of a sale or reorganization of ROI's business.
- Neither of us is responsible for delays or failures caused by events beyond our reasonable control.
